Roque nileksyonan si Lacierda sa amnestiyang iginawad ni Gazmin

Kinontra ng Malacañang si dating Presidential Spokesman Edwin Lacierda sa paggigiit nito na legal ang pagbibigay ng amnestiya ni dating Defense Secretary Voltaire Gazmin kay Senador Antonio Trillanes IV.

Kasunod ito ng pahayag ni Lacierda na saklaw pa rin ng kuwalipikadong political agency ang naging aksiyon ni Gazmin sa amnestiya para kay Trillanes.

Ginawang halimbawa ni Presidential Spokesman Harry Roque ang isang court jurisprudence sa kaso noong 1939 na Villena vs Secretary of Intetrior na naulit sa 2009 sa Angeles vs Gaite.

Nakasaad dito na ang kalihim ng mga departamento ay maaaring magpatupad ng ilang kapangyarihan nito sa ilalim ng batas, subalit hindi nito maaapektuhan ang constitutional power of control at kautusan ng Presidente ng bansa.

Malinaw aniya sa desisyon noon ng Korte na may ilang Constitutional powers and prerogatives ang Pangulo ng bansa na kailangan niyang maipatupad ng personal, kahit walang approval o ratification nh ibang tao.

“I just wanted to react to Atty. Lacierda’s statement that the grant of amnesty issued by Gazmin is covered by the qualified political agency. I beg to disagree, and for this purpose, we cite the case of Villena vs. Secretary of Interior, a 1939 case, reiterated in a 2009 case in Angeles vs. Gaite. I quote, “Secretaries of departments, of course, exercise certain powers under the law but the law cannot impair or in any way affect the constitutional power of control and direction of the President.”

The Court further ruled that, “There are certain constitutional powers and prerogatives of the Chief Executive of the Nation which must be exercised by him in person and no amount of approval or ratification will validate the exercise of any of those powers by any other person.” ani Roque.

Dahil dito, sinabi ng kalihim na ang kapangyarihang magkaloob ng amnestiya tulad ng kapangyarihan nitong magbigay ng pardon ay kailangang personal na maipatupad ng Presidente.

“The power to grant amnesty, like the power to grant pardon, must be exercised by the President in person,” ani Roque,” dagdag pa ni Roque.
