Red-tagging ‘di kailangang gawing krimen – Senate panel report

Hindi na kailangang gawing krimen ang red-tagging sa bansa dahil may mga legal na remedyo naman na maaaring gamitin ng isang aggrieved party.

Ito ang nakasaad sa rekomendasyon sa 66-pahinang ulat ng Senate committee on national defense na nagsiyasat sa diumano’y red-tagging ng ilang opisyal ng mga militar.

“Legal remedies, as exhaustively discussed in this Committee Report, are sufficient and available for personalities or groups that have been the subject of the so called ‘red-tagging’ and which some of them have already availed as evidenced by the cases filed in the Ombudsman,” sabi sa report.

“…this committee is of the view that criminalizing ‘red-tagging’ is no longer necessary since those who were or may be at the receiving end of red-tagging may avail of the legal remedies under existing laws if the alleged red-tagging violated their constitutional rights,” dagdag pa roon.

Sa halip na mag-isyu ng “general denial”, inirekomenda ng panel sa mga progresibong grupo na i-address na lang ang kaugnayan sa Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF).

Partikular na hinikayat nito ang Makabayan bloc sa House of Representatives na kondenahin ang CPP-NPA-NDF sa kanilang aktuwal na pananalakay laban sa gobyerno.

Sabi pa sa report, bagama’t mabilis na kinokondena ng progresibong grupo ang diumano’y paglabag sa karapatang pantao ng mga military at pulis, hindi naman nila ito magawa sa grupo ng mga komunista.

“This Committee recognizes that they have no legal responsibility, as freedom of expression includes the right not to speak,” ayon sa report.

“However, it is the position of the Committee that, as government officials who have taken their oath to uphold and defend the Constitution, they have at the very least the moral obligation to condemn the atrocities perpetrated by the CPP-NPA-NDF,” nakasaad pa sa report ng komite.

Ang committee report ay nilagdaan ng 13 senador.
