Pagbasura sa kasong may kinalaman sa shabu shipment, iaapela ng DOJ

Iaapela ng Department of Justice (DOJ) ang pagbasura ng Valenzuela Regional Trial Court sa kasong transportation of illegal drugs laban sa negosyanteng si Chen Julong alyas Richard Tan, customs fixer Mark Taguba at iba pang akusado sa P6.4 billion shabu shipment mula sa China.

Ayon kay DOJ Secretary Menardo Guevarra, maghahain sila ng motion for reconsideration sa Valenzuela RTC dahil hindi maituturing na forum shopping ang paghahain ng kasong transportation of illegal drugs dahil kaiba naman ito sa kasong drug importation na kanilang inihain sa Manila RTC.

“We will file a motion for reconsideration of the order of dismissal in the Valenzuela case (for transport of illegal drugs). There is no forum-shopping involved because transporting illegal drugs is a distinct act from importation (the case in RTC-Manila). The act of importation ends at the customs area. transporting the drugs to Valenzuela is a separate act punishable under a different provision of the dangerous drugs law,” saad ni Guevarra.

Posible umano na sa susunod na linggo ay maihain ang motion for reconsideration.

Kumpiyansa naman si Guevarra na ang desisyon ng Valenzuela RTC ay hindi makakaapekto sa nakabinbing kaso sa Manila RTC.

“The dismissal of the Valenzuela case for transporting illegal drugs has no bearing whatsoever on the pending cases in Manila for illegal importation of dangerous drugs. Those two cases are distinct from each other and are based on different provisions of the dangerous drugs law,” paliwanag ni Guevarra.
