BuCor chief Bantag sibakin – Drilon

Mas makakabubuting sibakin na lang sa puwesto si Bureau of Corrections (BuCor) chief Gerald Bantag.

Ito ang sinabi ni Senate Minority Leader dahil sa pagiging “uncooperative” sa pagbigay ng detalye sa kaduda-dudang pagkamatay ng mga high-profile na pumanaw dahil diumano sa COVID-19.

“I am tempted to say fire him and dismiss him, because he appears to be oblivious of the issue of public interest,” pahayag ni Drilon sa panayam sa ANC.

Siyam na high-profile na mga preso sa New Bibilid Prison (NBP), karamihan pawang mga convicted drug lords, ang naunang napaulat na namatay sa coronavirus at agad na ipina-cremate.

Kabilang sila sa 21 iba pang preso sa NBP na namatay sa COVID-19 sapul pa noong Marso.

“We lawyers have that principle in public offices, public officials are presumed to be performing their official functions. However, that presumption of the BuCor because of the record of past anomalies that we have unearthed in the Senate, like the sale of good conduct allowance, etc,” sabi ni Drilon.

“This presumption or regularity in the performance of official duties cannot be maintained, because the people have no longer confidence in the officials of BuCor,” sambit pa nito.

Una nang tumanggi si Bantag na ibunyag ang pangalan ng siyam na high-profile inmates at isinangkalan ang Data Privacy Act.

Subalit giit ni Drilon, dating justice secretary, hindi maaring gamitin ang data privacy law sa mga patay.

“The Data Privacy Act is to provide protection for the rights of living persons so that you cannot use or process the data that is given, especially for public record, to harm a person. You cannot harm a dead person. And that’s one, there is no basis for the invocation of the Data Privacy Act,” sabi ni Drilon.

“Number 2, public interest is involved. It’s a very specific exemption, even for the living, that the Data Privacy Act will not apply where you endanger the health of the community,” saad pa nito.

“In this particular case, there is no question that COVID is a circumstance that endangers the health of our people,” ayon pa sa minority leader.

Ayon kay Drilon, kailangan may transparency, lalo na ngayong pandemya, para hindi pagdudahan ng tao ang pagkamatay ng mga preso sa NBP. ANiya, kaduda-duda rin ang paggiit ni Bantag sa nasabing batas.

“The invocation of the Data Privacy Act raises suspicion that they’re covering something,” ani Drilon.

“It enhances the suspicion of our people that something is amiss, something is not right, something is being hidden. Therefore, you know, such actions should not merit his (Bantag) continued stay in the BuCor,” wika pa nito.
