Hindi na ikinagulat ni lead prosecutor at Batangas Rep. Gerville Luistro ang petisyon ng mga tagasuporta ni Vice President Sara Duterte sa Korte Suprema na kumukuwestiyon sa desisyon ng impeachment court na ibatay ang two-thirds voting threshold sa bilang ng mga senator-judge na regular na dumadalo sa impeachment trial.
Gayunpaman, sinabi ni Luistro na mas mabuti na inakyat na ng mga supporters ng pangalawang pangulo sa Korte Suprema ang nasabing usapin upang magkaroon na aniya ng pinal na desisyon sa isyung ito.
“I haven’t seen the petitions, pero I do not understand why we will be included because this is a ruling that was issued by the Honourable Impeachment Court,” ani Luistro dahil kasama aniya ang prosecution team sa petisyon ng grupo ni Atty. Vic Rodriguez.
“To add to that, anticipated natin yan Di ba Justice proceeding pa lang, nasa House palang inuulan na tayo ng petitions kaya it is no surprise for us na umakyat sila ng Supreme Court,” dagdag pa ng mambabatas.
Magugunita na ilang petisyon ang ihinain ng mga supporters ni Duterte habang dinidinig sa House committee on justice ang mga impeachment complaint laban kay Duterte subalit kalaunan ay ibinasura ng kataas-taang hukuman.
Noong Huwebes, nagsampa ng petisyon ang grupo ni Rodriguez matapos pagbotohan sa Impeachment Court na ibase ang 2/3 votes kung ilang senador ang regular na dumadalo sa impeachment trial sa pamamagitan ng 13 pabor, 1 ang tutol at 6 ang hindi bumoto.
“Siguro mabuti na rin yun para magkaroon ng finality yung issue of the Honourable Impeachment Court interpreting the phrase, all members of the Senate,” paliwanag ni Luistro.
“Yun lang gusto ko e-emphasize ha, the threshold was never changed. Two-thirds remains two-thirds,ang ginawa lang ng impeachment court ininterpret nila yung meaning ng phrase na all members of the Senate by way of saying hindi kasama yung nakakulong, hindi kasama yung may suspension, hindi kasama yung undergoing physical and medical incapacity, hindi kasama yung outside, the coercive power of the Senate and of course yung other similar situations,” dagdag pa ng mambabatas.
Malinaw din Luistro ang sinabi aniya ni Impeachment court presiding officer Francis “Chiz” Escudero na ang ruling ay pro hac vice o tanging si kaso ni Duterte ito gamitin at hindi puwede sa mga susunod na impeachment case sa hinaharap. (Bernard Taguinod)
