Inihayag ni Senador Rodante Marcoleta na hindi na siya lalahok sa impeachment trial ni Vice President Sara Duterte kung ipagpapatuloy umano ng impeachment court ang paglilitis sa paraang lumalabag sa Konstitusyon.
“I am no longer inclined to seek participation in the impeachment trial of Vice President Sara Duterte, including its eventual deliberations leading to the voting, if the Impeachment Court ultimately proceeds in a way that will desecrate the Constitution,” ani Marcoleta.
Muling binigyang-diin ni Marcoleta na hindi umano naaayon sa Konstitusyon ang pagtalaga kay Senador Chiz Escudero bilang presiding officer ng impeachment trial.
“The records of the 1986 Constitutional Commission confirm that the framers intended the Senate President alone to preside over impeachment trials, except when the President of the Philippines is on trial,” paliwanag niya.
Kinuwestiyon din niya ang posibilidad na gamitin ng Senado ang internal rules nito upang baguhin ang voting threshold na itinakda ng Konstitusyon.
Aniya, procedural lamang ang rule-making authority ng Senado at hindi nito maaaring baguhin o i-override ang mga probisyon ng Saligang Batas.
Dagdag pa ni Marcoleta, “If the Impeachment Court eventually adopts a threshold that deviates from the Constitution’s plain language and meaning, while the trial proceeds under a presiding authority of doubtful constitutional validity, these twin violations would fatally taint the legitimacy and integrity of the impeachment trial.”
Dahil dito, sinabi ng senador na ayaw niyang makilahok sa naturang proseso dahil maaari itong ituring na pagsang-ayon sa isang prosesong sa kanyang pananaw ay may constitutional infirmities.
“The Senate’s sole power to try and decide impeachment cases is broad but exists only within the bounds fixed by the Constitution,” pahayag pa ni Marcoleta.
Si Marcoleta ay kasalukuyang nakadetine kaugnay ng plunder case na nag-ugat sa umano’y P75 milyong campaign donation na natanggap niya noong party-list representative pa siya. (AM)
