Walang kapangyarihan ang Senado para iutos sa Bureau of Immigration ang pagpapadeport sa negosyanteng si Michael Yang na dating Presidential Adviser for Economic ni Pangulong Rodrigo Duterte.

Sinabi ni Presidential Spokesman Harry Roque na hindi pwedeng diktahan ng Senado ang ehekutibo para gawin ang utos dahil magiging paglabag ito sa separation of powers ng Ehekutibo at Senado.

“The Senate per se does not have the power to deport. It is in fact an executive function and the Senate cannot order the executive to perform a purely executive act –that would be violative of the separation of powers and the concept of equality of powers,” ani Roque.

Matatandaang inatasan ni Pangulong Duterte ang pulis at militar na huwag sundin ang mga senador sakaling ipag-utos ang pagpapaaresto sa mga iniimbitahang humarap sa imbestigasyon ng Senate Blue Ribbon Committee kaugnay sa isyu ng mga biniling medical supplies ng gobyerno sa Pharmally Pharmaceutical Corporation.

Si Yang ang itinuro ng mga opisyal ng Pharmally na financier ng kompanyang binilhan ng gobyerno ng medical supplies para sa pagtugon sa COVID-19 pandemic. (Aileen Taliping)
